Anton Piller Order Made Against Rogue Network Engineer

Published

This case illustrates how frail our computer networks can be: in this case deliberately being brought down by a disgruntled employee who had access to the network’s back-end.  Indeed, the employee was able to shut the plaintiff’s servers down from a remote location based on the way he manipulated the system internally.  As if this was not bad enough, the disgruntled employee went further and went on a social media campaign to defame the employer ownership.  The court was asked to grant an Anton Piller Order to allow the former employer (the plaintiffs) to seize and preserve evidence relevant to this case.  The court was satisfied that such an order was warranted, without any notice to the defendant.  It was a legitimate concern that if the defendant knew what was about to be seized, it would get deleted and/or altered.
