{"id":8896,"date":"2022-06-21T08:40:58","date_gmt":"2022-06-21T12:40:58","guid":{"rendered":"https:\/\/360mediations.com\/en\/?p=8896"},"modified":"2022-06-21T08:41:03","modified_gmt":"2022-06-21T12:41:03","slug":"adverse-possession-against-you-and-me-but-not-against-a-municipality","status":"publish","type":"post","link":"https:\/\/360mediations.com\/en\/adverse-possession-against-you-and-me-but-not-against-a-municipality\/","title":{"rendered":"Adverse Possession Against You and Me but not Against a Municipality"},"content":{"rendered":"\n<p><\/p>\n\n\n\n<p>Adverse Possession is a means upon which land can be lost by the true owner and gained by a squatter. \u00a0\u00a0This can occur legally when the squatter takes actual possession of the disputed land with the intention of excluding the true owner from possession, and that the true owner was effectively excluded from possession in circumstances where\u00a0 the act of possession is open, notorious, peaceful, adverse, exclusive, actual, and continuous for at least ten years.<\/p>\n<p>The interesting twist in this case was that the land in issue belonged to the City.\u00a0 The City didn\u2019t contest the fact that the squatter did everything correctly to acquire the land through adverse possession (ie: they built a fence around the City\u2019s parcel and occupied it for decades).\u00a0 The City argued that the law of adverse possession didn\u2019t apply to municipal lands.\u00a0 The court agreed.<\/p>\n<p>The court noted, amongst other things, that:<\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3366ff;\">\u201cThe City is simply unable to patrol all its lands against such adverse possessors. \u00a0The courts cannot demand the same vigilance of a private landowner to watch its borders of a public entity.\u00a0 \u00a0I find that a private individual must not be able to acquire title by encroaching on public lands and fencing off portions for their private use in the manner of two private property owners.\u00a0 \u00a0These lands, as originally acquired, were for a \u201cvery high public interest\u201d.\u00a0 \u00a0In these circumstances, the private landowner may not proceed to fence off public lands and exclude the public and succeed in a claim for adverse possession.<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span style=\"color: #3366ff;\">As a matter of public policy, this would be a dangerous precedent if allowed.\u201d<\/span><\/p>\n<p data-viibes-parag=\"4\" data-viibes-start=\"3\" data-viibes-end=\"2\"><strong><em data-toggle=\"dropdown\">Kosicki v.
