{"id":7849,"date":"2022-01-20T17:58:10","date_gmt":"2022-01-20T22:58:10","guid":{"rendered":"https:\/\/360mediations.com\/en\/?p=7849"},"modified":"2022-01-20T17:59:27","modified_gmt":"2022-01-20T22:59:27","slug":"divisional-court-summarily-dismisses-tenants-appeal-as-an-abuse-of-process","status":"publish","type":"post","link":"https:\/\/360mediations.com\/en\/divisional-court-summarily-dismisses-tenants-appeal-as-an-abuse-of-process\/","title":{"rendered":"Divisional Court Summarily Dismisses Tenant\u2019s Appeal as an Abuse of Process"},"content":{"rendered":"\n<p style=\"text-align: justify;\"><strong>Divisional Court Summarily Dismisses Tenant\u2019s Eviction Order Appeal as an Abuse of Process.\u00a0 <\/strong>The Divisional Court granted the Landlord\u2019s motion to summarily dismiss the appeal because the court was satisfied that the Tenant\u2019s appeal from the eviction order rendered by the Landlord &amp; Tenant Board was for no legitimate purpose other than to delay the tenant\u2019s inevitable eviction from the premises.\u00a0 As stated by the court,<\/p>\n<p style=\"padding-left: 40px;\">\u201cThis Court has repeatedly held that it is an abuse of process for a litigant to commence an appeal from an order of the Board for the purpose of obtaining an automatic stay of an eviction order, otherwise referred to as \u201cgaming the system\u201d: <em>Regan v Latimer<\/em>, 2016 ONSC 4132 (Div. Ct.), at para. 25; and <em>Wilkinson v. Seritsky<\/em>, 2020 ONSC 5048 (Div. Ct.) at para. 34.\u00a0 One of the key indicia that a tenant is trying to \u201cgame the system\u201d is where the Tenant has failed to pay rent for a persistent and lengthy period of time without a reasonable explanation or any intention to remedy the situation: Wilkinson, at para. 34 \u2026..\u00a0 (G)iven the long history of non-payment of rent and the lack of real effort to remedy the situation, this appeal is an abuse of process and should be dismissed on that basis alone.\u201d<\/p>\n<p><strong>Mubarak v.
