USER GUIDE

Using the Pierringer Payout Calculator
This handy calculator will help you to quickly determine how much each defendant will pay in damages when there is a Pierringer partial settlement between the claimant and one of the defendants.  The calculator also provides an analysis on how much better, or worse, the claimant does with the Pierringer Agreement in place, and how much of a credit the non-settling defendant will receive as a result of the partial settlement.  All that is required, as input, are: i) the quantum of damages awarded at trial, ii) the degree of fault attributed to each party, and iii) the amount the settling defendant agreed to pay (regardless of the outcome at trial).  Thereafter, the Pierringer Payout Calculator does the rest, based on the law as espoused in Gendron v. Doug C. Thompson Ltd. (Thompson Fuels), 2019 ONCA 293 (CanLII) ("Gendron").
For a more detailed understanding of the Gendron decision, you can read David's article entitled "Partial Settlement Structures – An imperfect solution to a complex resolution."
